Privacy Policy for Pendulo

This Privacy Policy explains how Xapper LLC (“Xapper”, “we”, “us”, “our”) handles your information in the Pendulo app (“the app”). Xapper LLC is the data controller responsible for the limited personal information described in this policy. This policy is written in plain language on purpose. If anything here is unclear, you can reach us through our support page.

Scope

This policy applies only to the Pendulo app. Other apps published by Xapper LLC may have different data practices and are covered by their own separate privacy policies.

The short version

We do not collect personal data through Pendulo. Your settings, presets, and other in-app data stay on your device. We have not built any analytics, advertising, or tracking into the app. We do not sell, give, or share your personal information. The only time we receive any personal information from you is if you choose to contact us for support.

What information is involved, and why

Data stored on your device. Your metronome settings, presets, themes, and similar preferences are stored only on your device. This information never leaves your device, and we never receive or have access to it. Deleting the app removes this data from your device, though a copy may remain in any device backups you have made (for example, iCloud or computer backups managed by Apple).

Anonymous statistics from Apple. Apple provides us with anonymous, aggregated statistics about the app — such as download counts, crashes, and general usage trends. This data is collected by Apple through the App Store and its platform services under Apple’s own privacy practices, not by anything we built into the app. It is not linked to you and does not identify individual users. We cannot use it to identify or contact you.

Purchases. If you buy Pendulo Premium, the purchase is processed entirely by Apple through the App Store. Apple handles your payment; we never see or receive your payment details (such as your card number). The app receives confirmation from Apple, on your device, that a purchase or refund occurred, and uses it to unlock or re-lock premium features. This stays on your device — it is not sent to us.

If you contact us for support. If you contact us — for example, by emailing us from our support page — we receive your email address and whatever you choose to put in your message. We use this only to respond to you and help resolve your issue. We may also use the content of your message — for example, a bug report or a feature suggestion — to fix problems and improve the app. When we do that, we keep only the relevant note (for example, “someone would like a darker color theme”) without your name or email address attached to it.

Legal basis for processing (for UK and EU users)

Where UK or EU data protection law applies, our legal basis for handling the limited information above is:

  • Legitimate interests: responding to your support requests, and fixing and improving the app based on feedback.
  • Performance of a contract: enabling the premium features associated with a purchase you make through the App Store.

We do not process special categories of data, and we do not use your information for automated decision-making or profiling.

What Pendulo does not do

  • We do not sell your personal information, and we do not give or share it with anyone else (including “sharing” for cross-context behavioral advertising, as California law defines it). The only exception is when we are legally required to, described below.
  • Pendulo does not track you across other apps or websites, does not use the Advertising Identifier (IDFA), and does not ask for tracking permission.
  • Pendulo has no analytics built into it — neither our own nor any third party’s. The only usage information we ever receive is the anonymous, aggregated statistics Apple provides (described above), which Apple’s platform collects, not the app.

These statements describe Pendulo. Any other app we publish is covered by its own policy.

When we might have to disclose information

We may disclose information if we are legally required to — for example, to comply with a law, court order, or valid governmental request. This is the only circumstance in which we would give or share the information covered by this policy with anyone.

How long we keep information

We keep support emails only as long as we reasonably need them — typically to resolve your issue and for a reasonable period afterward in case you follow up — and we delete them when they are no longer needed. Any notes added to our development backlog do not include your name or email address.

Your rights

Depending on where you live, you have rights over your personal information, including:

  • The right to know what information we hold about you.
  • The right to request a copy of it.
  • The right to ask us to correct it.
  • The right to ask us to delete it.
  • (UK/EU) The right to object to or restrict certain processing, and the right to data portability.
  • (California) The right to know, delete, and correct your personal information, and the right not to be treated differently for exercising these rights.

Because Pendulo stores your in-app data only on your device, the only personal information we might hold is a message you sent us. To exercise any of these rights, just contact us through our support page and we will take care of it. There is no charge, and we will not treat you differently for asking. We will respond to any request within the time required by applicable law — generally within 30 days.

UK and EU users also have the right to complain to a data protection authority — in the UK, the Information Commissioner’s Office (ICO); in the EU, your local supervisory authority. We would appreciate the chance to resolve any concern directly first.

Children

Pendulo is a general-audience music utility app and is not directed at children. We do not knowingly collect personal information from children. If you believe a child has sent us personal information, contact us through our support page and we will delete it.

International users

Xapper LLC is based in the United States. If you use the app or contact us from another country, any message you send us is received and handled in the United States. The information involved is minimal — an email you choose to send — and it is handled only as described in this policy.

Changes to this policy

If we change this policy, we will update the “Last updated” date above and post the new version on this page.
